Terms & Conditions

Note - For the purpose of this document Keith Moss Fine Art Photography (T/A Keith Moss Gallery) shall be referred to as KMFAP. The visitor to the site or the individual (whether representing an organisation or not) who orders an image shall be referred to as the Consumer/Client.

IN THIS AGREEMENT the term picture, image, product or purchase includes photography, or any other item which may be offered for sale.

NO VARIATION OF the terms and conditions set out here will be effective unless agreed in writing by both parties. In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the consumer/client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.

IMAGES SOLD no property or copyright in any picture passes to the consumer/client either on submission of the image or on the grant by KMFAP. NO reproduction rights for any image are granted.

THE IMAGES  the images are presumed to have been received in good condition unless the consumer/client notifies KMFAP in writing of any discrepancy or error within 14 days of receipt.

PERMISSION TO REPRODUCE AN IMAGE is not permitted or granted to the consumer/client.

Processing of orders and stock availability
We aim to process all enquiries and orders within 48 hours. All prices are quoted in UK sterling pounds and are inclusive of VAT.

Availability of products is subject to change without notice. If a product is out of stock we endeavor to notify you within 24 hours of us receiving your order. We will advise you when your purchase is expected back in stock and discuss your options with you. In this case, delivery may take longer but we will keep you informed at every stage about your order.

If after we have confirmed your order we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email or phone call, and refund when necessary. We will also offer you other options if this is acceptable. We reserve the right to vary these terms and conditions at any time, but in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted when placing your order.  If you require your order urgently for a special occasion, please CONTACT US PRIOR TO ORDER.

Delivery Information within the UK
Please be aware that many of our products are handcrafted, therefore please allocate enough time for this process to take place.  KMFAP pride ourselves on offering our consumer/client  a personal service, so if you have a special occasion coming up and you require your purchase quickly then please contact us prior to ordering, to ensure your delivery requests can be met.

Purchases will generally be dispatched free of charge for all UK orders first class delivery as standard. If you require an item for a specific date, or express delivery then the customer will incur the additional fee.

IMPORTANT NOTE: KMFAP will not accept responsibility for delivery of orders which do not arrive on time, due to circumstances beyond our control. We will of course, make every effort to dispatch the items within the required timescale and contact you if we think your order may be delayed.  As long as the item has been dispatched on the date specified and was scheduled for delivery as requested by the consumer/client, KMFAP is under no obligation to send a duplicate item or refund any postage costs.

Your statutory rights are not affected in this case and the consumer/client will still be under obligation to accept the goods when they arrive and use the returns procedure detailed to request a refund if you no longer require the item. KMFAP will not be held responsible for purchases which arrive too late for a special occasion. We recommend that all consumer/client allow adequate time for their order to be delivered. However, we will do everything possible to help you.

UK Delivery Charges
Delivery Charges (UK & Northern Ireland):
UK shipping is FREE using Royal Mail first class delivery.
If you require express delivery please contact us to see if it is feasible.  You, the consumer/client will be charged for this delivery. 

Delivery Information Outside the UK
We aim to dispatch orders received from outside the UK within 2 to 3 working days; however we cannot take any liability or guarantee delivery times. Please contact Royal Mail for further information. All packages are sent via air mail and must be signed for upon receipt. If you require a quick and fully traceable service, then please contact us prior to your order for a quote for international courier delivery.

Important: Please note orders outside the UK may be subject to import duties and taxes. Any customs or import duties are levied once the package reaches its destination country. Additional charges for customs clearance must be borne by the recipient. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you may want to contact your local customs office for further information.

International Standard Delivery -  (8-10 Working Days)
Express Delivery -  (3-5 Working Days)

Additional Charges
Consumer/clients with bespoke requirements may be subject to additional charges. Any additional charges will be made clear, once the individual requirements have been agreed with KMFAP and the consumer/client.

Packaging
Greetings cards are packaged and posted and sent flat in appropriate packaging. All open edition and limited edition prints are sent packaged and posted flat, not in tubes, and in appropriate packaging.

Our Responsibility
KMFAP cannot be held responsible for any disruption to services beyond our control. Whilst we endeavor to correct any disruption to our service, we do not make any promise that our website or service is error free. We believe
that our photographs and description show and describe our products as accurate as possible, however contrast, tones and shades may vary depending on individual monitors.
